Gyms in Condo buildings (not rental buildings)

Ask your lawyer the precedent by which your HOA can be found liable?
People can be sued for anything but there’s not a court in the country that has ruled third parties are liable for the spread of known communicable diseases.

Btw tell your HOA you are reducing payment of your monthly fees due to their not making the gym available.
Maybe what he's saying is find a new lawyer?
Mine is open, but we are only a 20 unit building so it was never crowded or busy to begin with.
Our gym is open via reservation only. They let us reserve an hour block three times a week. You have the gym to yourself for that hour. No vaccination records required or anything like that.

HoA building - same issue as you here. We've been closed during covid and will continue to do so until we get confirmation from lawyers. Can DM the building.
Yes please curious to know which buildings are closed. If you have any contacts on the board, I'd love to talk with them. I'm on the board of my building as well
Unfortunately, it's just the opposite here: Our gym has never shut down, and they've never enforced mask rules.
My condo is doing the same thing with the same exact excuse.

I was just inquiring with other board members at other HOA's to inquire how they're handling gym closure and legal advice. I'm trying to get a sense of what the overall approach that's occurring in town. That's all.

If I had to guess is that it's just a liability. It doesn't generate revenue at all so why risk it?
Also, I don't think they will even get a consensus among the other owners. There's been a wide variety of responses to the pandemic. Some (even 2 board members) never bothered to mask up at all when in shared spaces, but most people did.
Just bought a condo, haven’t moved in yet. But we have confirmation that the gym is open, no reservations or rules surrounding it
The gym in my building has been open for a long time now. And this week they removed the mask requirement.

I own in a condo building on willow. our gym is OPEN with a max capacity of i think 5 people. our pool will also be open this year with a 12 person capacity and 90 minute time limit. just curious what building you live in that the gym is still closed. Im considering moving.
Ours is open for months with limit on number of people who can use the gym at the same time
Tea Building finally opened the gym a couple weeks ago. You sign a two-page waiver and have to wear a mask while working out in there (this last part ends it for me — can’t work out in a mask). It’s also distanced inside the building.
