Hearing theories about how Trump can still win the election after this is going to be like hearing theories about how the Detroit Lions can still win the Super Bowl this year.

liquidthc

It's sad really. Makes me think of how all the Bernouts were still talking about how Bernie could still win up until Trumps inauguration.

songsongkp

This has been over from the beginning. I'm not sure why everyone actually believed this was going to make it and overturn the election. The burden was just too vast

[deleted]

Wherever your loyalties lay, whoever you voted for, this decision is a win for our country and a win for conservatism. The absolute **last** thing we need is the will of the people being thrown out by the system. We can dislike the result, but we **must** maintain and adhere to the process. We wouldn’t want our votes to be thrown out. No sense in asking that for someone else.

StateMyOpinion

Could someone briefly explain to me the "states cannot sue other states" thing people are claiming gave this lawsuit practically no legal standing? I'm interested in the law over politics.

captrex501st

Federalist notion sought to keep checks and balances a cornerstone of US democracy, incl. Congress ensuring upon Founding to put equal restrictions on the fed courts (as with the Executive w/ veto/appropriations, etc). Unser Article III of the Constitution, 3 elements must be satisfied to sue ANYONE in fed court: 1. Injury in fact (actual or imminent & concrete and particularized); 2. Causation (nexus point); and 3. Redressability by a favorable court decision. Usually plaintiffs can satisfy the 2nd and 3rd elements fine. Generally its the 1st element that will most likely to fail. Here, TX failed to state with cause that actions of other states internal legislative decisions on voting guidelines due to COVID restrictions actually/concretely injured/disenfranchised TX's own voting rights. In other words, TX cannot possibly state with proof that other states' decisions on voting per covid protocols actually resulted in TX's inability to account for its own citizens' voices.

TheMongoose101

This is actually very well explained. Nice job.

UnicornOnTheJayneCob

Excellent explanation. Well done, counselor.

Trumpwins2016and2020

A state can only sue another state if the plaintiff has incurred direct damages. Like, if a state pollutes a river that flows into a different state, the downstream state can sue. Generally, states don't have the standing to sue other states on their laws unless those laws directly and materially affect the plaintiff.

StateMyOpinion

Okay, that makes sense. Why do you think, with how popular this case got with other states and congressmen jumping on, that no one realized this?

Trumpwins2016and2020

They realized it, but they calculated that it'd get them a lot of votes with Trump voters mad about the election if they tried anyway. This was a political stunt to win votes. Most things politicians do can be boiled down to that

jmsnys

Because John Marshall said this: > it is entirely unimportant, what may be the subject of controversy. Be it what it may, these parties have a constitutional right to come into the Courts of the Union. The court can refuse to accept it obviously.

tysoncrosby21

If anyone expected otherwise you were fooling yourself.

DaHomieNelson92

Exactly. It’s better if we all just move on. At the end of the day, we are all Americans and should wish the best for our country.

gogol_bordello

Like most conservatives, we'll continue to do what we always do - hope for the best, plan for the worst. I really hope that Biden can move our country towards being more united with both his words and actions.

mercer1775

Out of curiosity is your flair ironic or are you an actual russian conservative?

0ttervonBismarck

Sadly a lot of MAGAworld prefers to throw Trumpertantrums rather than accept the results like an adult. In 2008 the Democrats were saying that they would never lose another election, and then 2010, 2014 and 2016 happened. There is a bright future ahead.

[deleted]

UnicornOnTheJayneCob

Thank you! I cannot understand why anyone thought this was a good idea, ESPECIALLY conservatives! If the suit had been successful states’ rights as we know them would have been over. I thought I was going out of my mind. The ends cannot justify means such as this. Completely not worth it.

fish_eye_surprise

Because a lot of "conservatives" aren't conservative anymore. Conservative used to mean small government, personal liberty and responsibility, free market capitalism, limited executive powers and.....STATE'S FUCKING RIGHTS. Now there's an absolute flood of...something else. But it is NOT conservatism. And the GOP has been complicit at best, negligent at worst, in eroding conservatism.

PicardBeatsKirk

This is exactly right. Most Republicans are just a different flavor of Authoritarianism now. The only group I see that falls under what you described now is Libertarians.

ThatsNotFennel

Thank you. I can't believe how many "Conservatives" decided this suit was okay because "Trump told me so." This was an egregious assault on states rights.

jeffsang

>What terrifies me is how many seem to be ready to just sacrifice the party for Trump. Including 106 GOP representatives. Everyone of them should be embarrassed that they were so afraid of going against a lame duck president that they were willing to put their name on this.

Clarkness_Monster

Throw the whole gop party away. Purdue voted for the bill that trump has been saying he will veto. That’s the thanks he gets for campaigning for them in GA? Screw them

jeffsang

Purdue is a senator, so not one of the 106 Representatives from the House. I’m not sure what bill you’re referring to. In general, I have no problem with senators disagreeing with the president on specific legislation. Right now, Purdue needs to consider how his votes will affect his chances at reelection, not what Trump thinks.

wrestler216

The party already sacrificed the people to appease the military industrial complex and big businesses. People are just finally standing up the same old bs from politicians that claim to be for the people but are no better than those on the other side.

moco94

Just remember that millions of dollars were donated for “legal fees” to a self proclaimed billionaire for this..

mrducky78

Once conned, twice shy. You would think people would learn from Trump's history. I 100% reckon if he isnt in jail, people will be opening their wallets up for him to take in 2024. And even if in jail, some constituents just arent smart y'know.

dmcnaughton1

Hardly surprising. There's no provision in the constitution for Texas to sue Pennsylvania over a matter of Pennsylvania state law. To allow that would destroy the entire foundation of federalism and state sovereignty.

Hyperdrunk

SCOTUS agreed 9-0 that the case had no merit and 7-2 that states can't challenge the laws of other states at all in the first place. That's pretty clear-cut on the "no" front.

dangermond

Hearing this case Would have cracked a door we would never have shut ever again. States would have been suing other states over COVID response, over gun laws etc...

Barack_Lesnar

States already tried suing each other over weed legalization.

RaWR_TX

TX would have a fit if CA or New Nevada tried to sue them

captrex501st

It's a justiciability question. TX has no Article III Standing (no injury in fact) to sue other states' internal matters.

Krampus1313

Wait until anti gun states sue gun friendly states

Jessica-Gavit

I got rebuffed by so many people here because of this. So I was like "fine, I'll just wait for this thread".

Trump has a better chance of being elected as the God-Emperor of Mankind than the Lolions not being incompetent.

... If Bernie splits the EC vote, then etc etc.

ThienHuuDo

Yeah it’s getting annoying tbh.

I'm still hoping on them both getting DQ'd giving Jorgensen the win.

“Here’s how Bernie can still win”

pfloyd1973

You read my mind

ThienHuuDo

Yep, finally off this wild ride. It was an entertaining 4 years, the memes have been incredible.

team_dale

Agreed, well played dems. Let’s hope joe does the best job possible for the next couple of years. Meanwhile - back to work

ThienHuuDo

Yep, I’m skeptical as hell but like Dave Chappelle said in his monologue after Trump’s win in 2016: “I wish him luck and I’m willing to give him a chance.”

LieutenantSnuggles

Wait, we aren’t gonna riot and burn our neighbors’ businesses?

Mr_Incredible91

No, I have work in the morning. Too much shit to do etc.

IamMikeLowery

Did you see the Biden memes from the Obama years? The best is yet to come

pfloyd1973

Yeah we had some good times. Let’s focus on the wins we made in the house and at the state level. 73 million Americans voted for our ideals, we may have lost this battle but the fight still goes on.

EdwardWarren

We need some vision people. We need some young candidates. We need to get a vision and a message, stick to it, and let people know we are the party of the people that will make America great. Most of all we need message discipline and smart answers to every question. Every day and every person. Any attack by the left should be immediately answered in all the media across the board with an intelligent response by a member of a media strike force who is trained to deal with media butt heads. And yes, we need to welcome all Americans into the party and end all connections with far right extremism. Create a party all Americans would be proud to be a part of.

cathbadh

>We need some vision people. We need some young candidates. Unfortunately it isn't going to happen. Trump will either run in 2024 or hand select someone and ensure all others are obliterated at a personal level with nonstop attacks and lies on them and their families.

ninernetneepneep

Yup, think I'm going to have to step away for a few years. It's exhausting and obvious I have zero control of what is happening.

Yep! Now we can move on and see what’s next in store. This was all a headache. I’m glad that a lot of people got to see how much the media was involved in creating the narrative though

CrimLaw1

Not a surprise to anybody in the legal field, they didn’t have standing.

TheMongoose101

Y’all can be pissed off, I get it, but he isn’t wrong. There is no provision that would give Texas or any other state standing on this. It was always a long shot. The most likely case to be taken up was the PA one, and that wasn’t even given a writ.

monsieurnolan

I suppose it was, in the end, possible to mess with Texas.

[deleted]

Bubba's gonna be pissed!

IO_engineer

Do not remember the Alamo!

H_psi_E_psi

This was never about accomplishing anything to begin with. Anyone who has the slightest clue about the laws involved knew that this suit had no teeth. This is all about the individuals involved to demonstrate their pro-trumpness to increase their prospects for future elections. Noone expected this to go anywhere.

[deleted]

[удалено]

UnicornOnTheJayneCob

Yes it was significant that it was the Texas AG who brought the case, not the solicitor general (whose literal job it is to represent the state to SCOTUS). The SG’s silence on the whole thing was fairly deafening.

what_it_dude

That's a good point, I never looked at it from that angle.

dokital

Look at this sub. Most here are seemingly in some fever dream.

neurosthetic

How long until the "Gorsuch, Kavanaugh, and Barrett were part of the deep state all along" folks start piping in?

[deleted]

Trump: Fighting the Deep State by appointing Deep State operatives to lifetime positions they have almost no chance of ever being removed from. Like, even if we were to grant that the Deep State is a real thing and all those people Trump has appointed are really Deep State operatives, the only conclusion you can make from all this is that he's *really bad* at fighting the Deep State.

cathbadh

It'll either be that or the martial law mental masturbation. Trump's gonna send the Army to do new elections that'll be totally fair and he'll win this time!!!!!

panicx

Well, they were nominated by a rich New York celebrity, so there’s that.

RickyPickyRick

I’m already seeing it on Parler....SMH

TheCoolmeista

Just curious, does Goldwater conservative mean you are pro-choice?

RickyPickyRick

I believe that government should stay out of ALL personal matters and choice.

TheCoolmeista

Wouldn’t that make you more libertarian? Obviously you know more about your political beliefs than I do, so you know what you are more aligned towards.

RickyPickyRick

Goldwater’s beliefs definitely have libertarian leanings.

man this whole thing has fucked the GOP big time. i’m not confident at all in winning the senate runoffs. and i’m not too confident in the state of future elections and republican nominees.

Ballin095

Tbh, I'm not confident on our future elections in general.

OfficerTactiCool

Because every GOP platform stance is from the 60s-80s. GOP needs to modernize their stances if they intend to win elections

Dan888888

>conservative >modernize pick one

[deleted]

[удалено]

JaXXXuP

It's not though. The only thing the GOP has left from that era is the pro life, pro 2nd amendment... idk... we pretend to still have that financial policy I guess? No one cares about gay marriage any more, No one cares about weed anymore...

sbelk27

The only “care” anyone has about gay marriage is still the possibility that churches could be sued for not allowing these ceremonies in their churches. That is still legitimate. As far as weed goes, most people want it legalized. There’s too much evidence supporting medicinal use, and the fact that cocaine is a lower scheduled drug is laughable. Most people are sick of our prisons being full of people who were arrested for marijuana. Get it off the black market, have some regulations over product and age restrictions for rec use.

wrestler216

Modernize their stances 😂. Do you even know what Conservative means?

OfficerTactiCool

It’s possible to be both conservative and modern.

collymolotov

Why would Trump supporters want to make their political situation even worse and open the door to the massive structural changes championed by the Democrats by not voting GOP in the runoffs? That seems like cutting off ones nose to spite their face. It’s bad now but not voting in the runoff’s can make the situation exponentially worse for conservatives of every stripe.

Dr_Valen

Why would the people want to vote in the same crony republicans that have done nothing for the people? Trump was the populist candidate that was making efforts to end the forever wars and the other shit career politicans have done. The crony GOPs are no better than the Dems in that matter. Fucking voting for them just because they have an R next to their name. That is what got us into this mess with the dems.

[deleted]

Eh we said the same thing about the Dems in 2016. Over all I think Trump hurt Republicans. But I think we'll be just fine.

pfloyd1973

He got the most minority support for any Republican since 1960. He got more votes as an incumbent than when he first ran (which is incredibly rare), and we had a great charge where we gained seats in the house and at the state level. Trump gave the GOP a restructuring.

TacTac95

If this election was anyone but Trump it probably would’ve been a landslide victory. Fortunately, the Democrats’ main source of voter fervor is gone and they have a void of support of fill over the next 4 years.

pfloyd1973

I see what you’re saying. But we have an energized base and most people voted for Biden because he wasn’t Trump. They may hold power at the presidency, but the GOP had a pretty significant victory as well.

Garuda_4

>But we have an energized base not anymore dude. im fucking done with republicans if this is the shit they wanna pull. a ton of conservatives feel the same way. the party is effectively dead

Ballin095

Absolutely true. Trump resurrected the republican party, and just like the Falcons did in the Superbowl, they fumbled away their chance to win. What a shame.

[deleted]

[удалено]

ClaymoreRoomba2A

I don’t think Trump has hurt the Republican Party. I think Trump opened the eyes of many people on the right to just how bad democrats and republicans are in politics. The swamp may not have been really drained but there is now a huge group who wants people D&R alike to be outed from positions of power in the government. If we keep the momentum going we can get corrupt politicians out of government, eventually. Furthermore Conservatives now more than ever need to really push to **conserve** things such as the constitution. Every single debate amongst republicans needs to focus on things such as the 1st and 2nd amendment. The right needs to be on the offensive when it comes to gun laws instead of always being on the defensive when the left pushes gun laws and then finally breaking down and compromising. Any and every sort of “hate speech” policy suggested by the left should be immediately shut down by the right, to preserve the 1st amendment. Old republicans in office need to leave and new ones need to agree on term limits. Republicans need to become more libertarian, weed is a pretty big topic now, I hate to suggest doing things for votes but the right in general should be ok with making weed legal, it will get us votes and God knows we need votes when every major media/ social media corporation is left leaning and in charge of what the general population sees. Sorry to rant, I got way off subject lol. I’d honestly love to run for office because I feel so strongly about this stuff, including corruption no matter what party. If I actually ran I’d run on the constitution and honesty/integrity and would vow to never become corrupt. Edit: anyone who disagrees with me you can PM me if they have an argument, it kinda sucks everyone is getting deleted since they aren’t Flaired

Mr_Incredible91

No the dems will win the senate runoffs because of its one thing the GOP can never stay focused on long enough is the long game.

UltimaterializerX

Makes sense. Allowing this would have gone directly against the 10th amendment.

dangermond

Hearing this case would have cracked a door we would never have shot ever again. States would have been suing other states over COVID response, over gun laws etc...

mycha1nsarebroken

Well, at least we can stop humoring those conservatives who seemed to be blind to the reality that any chance was exceedingly slim.

Time for Trump to declassify everything from 2015-2020 and tell us whether or not there are aliens 👽. But in all seriousness, it's exhausting and feels pointless about now so I'm choosing to duck away for a while, cross my fingers, and hope for the best.

Lawyers have been doing this shit forever, and it needs to stop. By that I mean getting on TV and straight up lying to the camera, because, well, it's not a crime to do so. I get you're hired to do a job, specifically to represent your client and his/her interests. However, I do not think it is should be legal to fabricate elements of judicial proceedings, publicly.
